1. Acceptance of Terms

By downloading, installing, or using Pregnancy App (the "App") or accessing our website at pregnancyapp.com (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Pregnancy App ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Description of Service

Pregnancy App provides pregnancy tracking tools, hypnobirthing meditations, a contraction timer, baby kick counter, due date calculator, breathing exercises, and related educational content (collectively, the "Service").

The Service is available as a mobile application on iOS and Android, and through our website. Some features may be available only on certain platforms or require a paid subscription.

3. Medical Disclaimer

Pregnancy App is NOT a medical device. The Service is intended for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

• The contraction timer is a convenience tool. It does not diagnose labor or provide medical guidance on when to go to the hospital. Always follow your healthcare provider's instructions.
• The baby kick counter is designed to help you track fetal movement patterns. It is not a medical monitoring device. If you have concerns about your baby's movements, contact your doctor or midwife immediately.
• The due date calculator provides an estimate only. Your actual due date should be determined by your healthcare provider based on clinical assessment.
• Hypnobirthing meditations and breathing exercises are relaxation techniques. They are not medical treatments. Results vary from person to person.

Always seek the advice of your doctor, midwife, or other qualified healthcare provider with any questions you may have regarding a medical condition or your pregnancy. Never disregard professional medical advice or delay seeking it because of something you read or heard in Pregnancy App.

4. User Responsibilities

When using Pregnancy App, you agree to:

• Use the Service only for its intended purpose as a pregnancy companion tool.
• Not rely on the Service as a substitute for professional medical care.
• Not attempt to reverse engineer, decompile, or disassemble any part of the App.
• Not use the Service for any unlawful purpose or in violation of any applicable laws.
• Not distribute, modify, or create derivative works based on our content without written permission.
• Keep your device and app updated to ensure the best experience and security.

5. Intellectual Property

All content within Pregnancy App — including but not limited to text, audio recordings, meditations, graphics, logos, icons, user interface design, and software code — is the property of Pregnancy App or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes. This licence does not include the right to:

• Copy, redistribute, or publish any content from the App.
• Record, re-record, or redistribute audio meditations or breathing exercises.
• Use our trademarks, logos, or branding without prior written consent.
• Use automated tools to scrape, extract, or harvest content from our Service.

6. Subscriptions & Payments

Pregnancy App offers both free and premium features. Some content and features require a paid subscription.

• Billing: Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to the payment terms presented at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings.
• Free Trials: If we offer a free trial, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable fee.
• Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
• Price Changes: We reserve the right to change subscription prices. Existing subscribers will be notified of any price changes in advance, and the new price will apply at the next renewal date.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Pregnancy App and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or profit.
• Personal injury or health outcomes.
• Interruption of service or loss of access.
• Any damages arising from your reliance on information provided by the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pregnancy App, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any content you submit or transmit through the Service.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using the Service at any time by uninstalling the App. If you have an active subscription, please cancel it through your app store settings before uninstalling to avoid future charges.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and governing law — shall continue to apply.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved in the competent courts of Romania, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
